Amigo Status Challenge - Terms and Conditions
Terms and Conditions Introduction
These Terms and Conditions apply to your use of the Online Form to request a status match to Star Alliance Gold Status in a participating FFP of your choice or to a similar request in relation to the Online Form. The request of such status match using the Online Form or the processing of a related request is referred to as the Activity. The Activity is not conducted on behalf Oceanair.
Acceptance of These Terms:
By participating in the Activity, you are deemed to have understood and agree to be bound by these Terms and Conditions and fulfil all requirements qualifying you as an Eligible Entrant. Your participation in this Activity is subject to your acceptance of these Terms and Conditions. Without agreement to these Terms and Conditions, you will not be allowed to participate in this Activity. You will be asked to expressly accept these Terms and Conditions when you register for this Activity. Please retain a copy of these Terms and Conditions for your future reference.
This Activity is only open to Oceanair Amigo FFP members over the age of eighteen at the time of participation in the Activity that hold an Amigo Gold or Amigo Diamond status valid on 01 March 2019 (“Eligible Entrants”). Only if you are an Eligible Entrant may you participate in the Activity.
The Activity allows you, if an Eligible Entrant, to request for yourself a status match in one Participating Star Alliance Frequent Flyer Programme as defined in Section 07 (a “Selected FFP”) of your choice for the conferral of Star Alliance Gold Status in that Selected FFP. For the purposes of the activity, you must request such status match using the Online Form, unless otherwise necessary. Your Eligibility to request a Status Match will be confirmed via the Online Form. If your application is valid, you will be contacted by the Selected FFP confirming conferral of the status or the challenge within eight weeks of the submission date. In case the validation is not successful, you may be requested to provide additional information within eight weeks of the submission.
The Organiser of this Activity is Star Alliance Services GmbH (the “Organiser”), whose offices are situated at Frankfurt Airport Center, 5th Floor, Frankfurt D-60546, Germany. To the extent permitted by the applicable law, all decisions made by the Organiser in all matters regarding this Activity are final, no correspondence will be entered into and recourse to the courts shall be excluded.
Duration of the Activity:
The Activity starts at 12:00:01 GMT on 04 November 2019 (the “Starting Date”) and ends at 23:59:59 GMT 30 November 2019 (the “Closing Date”). Entries received after the Closing Date of the Activity will not be considered.
Participating Selected FFPs:
The Selected FFPs participating in the Activity and the respective Star Alliance member carriers they belong to/owners (the “FFP Owners”) are as follows:
- Air Canada - Aeroplan®
- Avianca – LifeMiles
- Copa Airlines – ConnectMiles
- TAP Air Portugal - TAP Miles&Go
- Turkish Airlines - Miles&Smiles
Mapping of Star Alliance Gold Status:
In case there are two or more tiers in the Selected FFP matching to Star Alliance Gold Status, the FFP Owner of the Selected FFP has the right to choose the status and tier to be given to you.
a. Use of Online Form: To participate in the Activity, you must fully complete the Online Form available at https://www.staralliance.com/br-status-challenge.
b. Single Request Limit: You may register in the Online Form once and apply for a Status Match in only one of the participating FFPs. In case you apply for multiple FFPs, only your first submitted application via the Online Form will be considered.
c. Reward Mile Exclusion: Any points/reward miles you accrued in the Oceanair Amigo FFP will not be transferred to your Selected FFP under this Activity.
d. No Purchase Necessary: No purchase is necessary to enter this Activity.
e. Unsuccessful Entries: Any entries that are illegible, lost, delayed, misplaced, misdirected, incomplete or cannot be delivered or entered for any technical or other reasons, or fail to comply with or do not expressly accept these Terms and Conditions, cannot be considered. Proof of transmission is not a proof of receipt.
f. Registration with Selected FFP: In case you are not yet a member of your Selected FFP, you must register as a member with the Selected FFP first and obtain membership to be able to input your Selected FFP membership number into the Online Form.
g. Relationship to FFPs of Star Alliance Member Carriers: Neither these Terms and Conditions nor the Activity seek or do restrict any status conferral that could be extended by a Member Carrier of Star Alliance under its FFP or by the owner of such FFP. This Activity merely provides one way of requesting a status match from participating Selected FFPs, subject to these Terms and Conditions.
h. No Right to Automatic Status Conferral: The scope of the Activity is limited to you requesting a Star Alliance Gold Status from one of the Participating Selected FFPs listed in Section 7 using the Online Form or in relation to the Online Form. Some Participating Selected FFPs have defined a number of preconditions that need to be met for your receipt and/or retention of any status granted. Any application for status in your Participating Selected FFP is subject to those preconditions and their satisfaction – no automatic right or entitlement to status exists.
Star Alliance Gold Status:
The Star Alliance Gold Status entitles you to Star Alliance Gold Status benefits (as defined here and as amended from time to time, hereinafter the “Star Alliance Gold Benefits”) on the Selected FFP. The benefits associated with the granted status and tier in the Selected FFP and the validity of the Star Alliance Gold Status are subject to the decision of the FFP Owner and subject to the terms and conditions of the Selected FFP but will in any case include the applicable Star Alliance Gold Benefits.
Your Amigo FFP Status
Oceanair ceased to be a Member Carrier of Star Alliance on 01 March 2019. As a result, the Amigo FFP ceased to be an FFP of a Member Carrier of Star Alliance along with all benefits associated with such membership. Neither the Activity nor any provision of these Terms and Conditions change the foregoing.
At any time during the Activity, the Organizer reserves the right in its sole discretion to disqualify any participant in this Activity for any failure to observe these Terms and Conditions including, but not limited to, cases where the Organizer believes the participant to be engaged in any kind of illegal or inappropriate behavior, or in contravention of these Terms and Conditions. A delay in enforcing such disqualification will not preclude it from being enforced at a later point in time.
To participate in this Activity, you will need to provide the following Personal Data of yours: First Name, Last Name, email address and Oceanair Amigo FFP Number. In addition, you must select your Selected FFP and provide your Selected FFP number. Your Personal Data will be processed in accordance with the Privacy Statement.
Limitation of Liability:
By entering the Activity, and subject at all times to Section 15, you release to the fullest extent permissible by the applicable law, the Organizer, and any of its respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies and the FFP Owners and applicable Member Carriers of Star Alliance (collectively, the “Released Parties”) from any liability whatsoever, and waive any and all causes of action related to any claims, costs, injuries, losses or damages of any kind, whether consequential or otherwise, arising out of or in connection with the Activity or delivery, misdelivery, acceptance, possession, use of or inability to use the Star Alliance Gold Status (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under contract, tort (including negligence), warranty or other alleged cause of action.
Exclusions to Limitations:
Nothing in these Terms and Conditions limits or excludes, or will be deemed to limit or exclude, the Organizer’s liability for fraudulent misrepresentation, death or personal injury caused by its negligence or liability that may not otherwise be limited or excluded by law.
Non-Liability of Organiser:
Subject at all times to Section 15, the Organiser shall not be responsible for any breaches of contract or any actions or omissions on the part of the Member Carriers, the FFP Owners or any of its or their agents, contractors and subcontractors, nor shall the Organiser be liable in any way for any loss or damage arising in connection with this Activity, for any reason whatsoever, including but not limited to any illegible, lost, delayed or incomplete entries, error in computing, any breakdown or malfunction in any computer system or equipment and any notice which is misdirected.
The Organiser may, at any time, at its sole discretion and without prior notice, amend or modify these Terms and Conditions and may also suspend, interrupt, terminate or discontinue this Activity at any time (as it may reasonably deem necessary due to circumstances beyond its control) without notice or liability to anyone. This applies in particular, but is not limited to, in the event of any circumstances that disrupt the Activity or prevent it from proceeding as planned.
Any questions, comments or complaints regarding the Activity shall be directed to the Selected FFP, in case they relate to status match as such. Questions related to the Online Form shall be directed to staralliance.com(at)staralliance.com.
This Activity is void in all countries where it is illegal by law.
Social Media and No-Endorsement:
For the avoidance of doubt, this Activity might be communicated via social media channels such as, but not limited to, Facebook. These social media channels do not actively endorse the Activity, even if used as platforms for communication.
The English version of these Terms and Conditions is the sole authorised version of these Terms and Conditions. While every endeavor has been undertaken to translate these Terms and Conditions into Brazilian Portuguese, any conflict between the Brazilian Portuguese and the English version is to be resolved in favor of the English version in each and every matter, and regardless of the degree of variation or importance between the English and the Brazilian Portuguese versions.
Unless otherwise required by the mandatory operation of an applicable law, this Activity and any disputes relating to it will be interpreted by the laws of England and Wales and be subject to the exclusive jurisdiction of the courts of England and Wales.
